〔自由時報記者侯柏青／台北報導〕台北市永春都更戶彭龍三因不滿都更政策，98年在網路發表「淫賤營建署」、「營建署的狗官聯合詐騙集團」等文字，遭台北地檢署起訴他侮辱公署，但台北地方法院認為，人民意見表達應優於政府名譽法益，昨判彭無罪。

委任律師童兆祥表示，彭龍三獲知判決結果很振奮，盼檢察官勿再上訴，且政府應有接受人民批評的雅量；但檢方得知無罪判決後，傾向上訴。

類似判決有前例，三立《大話新聞》名嘴何博文評論苗栗縣竹南「大埔事件」時，苗栗縣長劉政鴻認為何影射他是「狗官」而提告，法院也以言論自由獲保障為由，判何博文無罪。

住戶振奮 檢傾向上訴

判決指出，彭龍三不滿都更案政策，98年9月底在網路上刊登「淫賤署」、「不論以後這些狗官再怎麼跟大家說法律是公平公正的，都不要再相信，因為狗絕對可以為了舔資本家的屁眼，而用很多理由出賣小老百姓的身家利益，當然也包括他們微不足道的狗屁尊嚴」、「營建署的狗官聯合詐騙集團曲解了法令」。

彭又在99年11月13日po文「在財團面前不可一世的主管機關首長包括警分局長都像是吃狗飼料長大的」，北檢依侮辱公署罪將他起訴。彭某承認寫這些文章，但他強調都是批評公共政策，講話有憑有據，自認無罪。

法院認為，言論自由是我國《憲法》保障的範圍，大法官吳庚曾在大法官解釋時提出協同意見書，指出「在民主多元社會各種價值判斷都應該容許，對於可受公評的事項，尤其是政府的施政措施，縱使以不留餘地或尖酸刻薄的語言文字加以批評，也應該受到憲法保障。」

法院指出，本案涉及重大公益事項，且引起軒然大波，這些政府單位掌握政府高權，本就有承受公眾檢視甚至批判的義務，不能隨便用刑責限制民眾，彭龍三指責營建署的言論雖然稍嫌粗暴，但尚在言論自由的保障範圍，故判決無罪。
