新北市府衛生局今天表示，去年8月起，接獲樹林、中和、土城、三峽、汐止及淡水等地民眾投訴，指某檢驗所人員到公司或居家推銷肝癌篩檢，並預約於隔日上午抽血檢體，並推銷健康檢查項目。

民眾覺得怪異後，要求退費卻被檢驗所拒絕，於是向衛生局檢舉。衛生局調查，檢驗所的手法，都是先以低價誘導民眾簽下檢體採集同意書，翌日派人上門抽血，涉及不當招攬業務。

衛生局依照醫檢師法，開6張罰單，共罰新台幣26萬元整。衛生局副局長林金富說，醫檢師必須在醫檢所執業，接受醫師的檢驗單採集檢體。不論是派員外出抽血，或到府衛教宣導，及發放檢驗單，請民眾到檢驗所抽血的行為，都已涉及「不當招攬」業務。

不過，遭處罰檢驗所的法務代表黃智靖今天受訪表示，依據醫事檢驗師法第12條，醫事檢驗師執行業務，應依醫師開具之檢驗單為之。但經中央衛生主管機關指定，或自費至醫事檢驗所檢驗之項目，不在此限。

黃智靖說，主動到社區服務不但方便民眾，且依照衛生署民國99年的函示，在檢驗預約單上，明白列出自費檢驗項目的金額，民眾也可以不附任何理由，取消預約不影響任何權益。

檢驗所表示，推廣全民健康與疾病預防的作法，與衛生局在社區做巡迴篩檢的作法是一樣的，且這些採集檢體過程，並非醫療行為；法律也沒有禁止民眾自費檢驗，並未規定民眾要「親身」至檢驗所接受採檢。

八、臨床生理檢驗。
九、醫事檢驗業務之諮詢。
一○、臨床檢驗試劑之諮詢。
一一、其他經中央衛生主管機關認可之醫事檢驗業務。
醫事檢驗師執行業務，應依醫師開具之檢驗單為之。但經中央衛生主管機關指定或自費至醫事檢驗所檢驗之項目，不在此限。
前項但書規定於本法公布施行之日起，試行五年，屆期重新檢討。
