愛滋器捐究責醫師　醫界：應從制度除錯

2011年8月臺大醫院爆發愛滋器官移植事件，當天參與移植的醫師日前被台北市衛生局移付懲戒，同時間檢方也展開約談，包括醫療改革基金會以及婦產科、兒科等多個醫學會今27日舉行聯合記者會，呼籲主管機關應從制度除錯，若只追究個別醫師的疏失，未來仍可能再度發生影響病人安全的事件。

醫改會研究發展組組長朱顯光表示，衛生署至今沒有公開分析報告，讓醫界以及大眾知道這場移植的錯誤如何產生，也沒有從制度上建立更有效的防錯機制，反而只怪罪人員的螺絲鬆了、要找人負責任，類似的錯誤未來可能發生在任何科別。

代表兒科醫學會的臺大兒童加護病房醫師呂立指出，衛生署針對這場移植錯誤提出的新措施，就是要求勸募以及移植的醫院之間，一定要傳真書面檢驗報告，然而他表示傳真這種土法煉鋼法不僅費工時，也增加病人隱私曝光的風險，臺大曾多次建議器捐移植登錄中心只要修改電腦程式，讓捐贈者資料在院際分享前改用一個匿名、全國唯一的編碼來取代姓名，就可讓參與的醫院直接上網看資料，快速且保護隱私，但未被接受。

呂立醫師指出，加強確認資料的正確性是對的，但是使用更複雜、更危險的方法，不僅增加多倍的行政流程，也讓團隊沒有時間再去多勸募，讓很寶貴取得的捐贈資源被制度卡住，患者可能更不容易等到移植器官。

婦產科醫師、同時也是2011年不責難補償制度國際研討會召集人葉光芃表示，婦產科被公認是最容易引起醫療糾紛的科別之一，然而國外的經驗顯示，在制度上採取醫療無過失制度的國家，醫師才願意從錯誤中學習經驗，醫療錯誤率反而可降低。

然而，葉光芃醫師認為國內動不動就對醫師施以刑法、民法究責，今年神經外科有醫師被判賠3千萬元、過去麻醉科曾有4千萬元判例，至於婦產科的糾紛更不勝枚舉，他表示造成的影響就是大家不願走高風險科別，以婦產科為例，40歲以下醫師僅377人、占全國醫師總數的2.5%，他擔心臺大移植團隊遭懲戒一事，也會讓醫學生視移植等高風險科別為畏途，步上婦產科人力斷層的後塵。

不責難醫療補償 醫團籲引入

（中央社記者曾盈瑜台北27日電）醫師團體今天舉行記者會，呼籲行政院衛生署公開台大愛滋器捐案原因報告，並呼籲立法院修醫療法，引入北歐國家「不責難醫療補償」制度，從系統改善醫療體制，非追究個人責任。

台北市衛生局日前表示，已將台大愛滋器捐誤植一事關係人共9名，移付北市府醫師懲戒委員會討論。台灣醫療改革基金會、台灣醫學生聯合會與台灣婦產科、兒科、急診、麻醉、眼科醫學會與台灣神經學學會上午在立法院舉行記者會。

醫改會研發組長朱顯光表示，針對愛滋器捐事件，衛生署做法無法解決系統性問題。希望立法院修改醫療法，將來若有重大醫療事件發生，應有超越衛生署層級的跨部會小組，邀醫學專家介入調查，公布根本原因分析報告（Root Cause Analysis, RCA），讓各方了解錯誤發生的根本原因並從錯中學。

眼科醫學會副秘書長戴明正說，希望修正醫療法，在故意或重大過失情況下，醫師才有刑事責任，刑期與罰金提高；但其他醫療事件，則參照國外不責難補償制度。

彰化基督教醫院醫師葉光芃表示，北歐國家的「不責難醫療補償」，是透過成立醫療事故補償的病人保險協會，當病患發生醫療傷害，就可由醫療人員協助病人呈報，啟動補償，減少醫療訴訟，讓醫師免於訴訟之苦。當不幸事件發生時，醫師也會勇於認錯，甚至協助病患取得補償。

戴明正認為，訴訟體制的責難易引起醫師防禦性醫療，不責難補償制度能促使醫師承認錯誤、使醫療傷害真相更清楚，醫療品質更高，保障民眾就醫權利。

醫學生聯合會副會長朱彥豪說，希望衛生署在器捐流程改革上，找出系統、制度錯誤，並揭露真相，而不是聚焦9名醫師誰失職；如果未來醫療改革沒往除錯方向行進，醫學生恐怕將視高風險科別為畏途，環境未改善，民眾權益也受損。1010427
