....多位有案在身或形象不佳的司法官，為避開「法官法」禁止涉案法官、檢察官轉任律師等規定施行後，無法再當律師，最近紛紛向各地方律師公會申請執業。


涉案司法官被停職後常轉任律師，法務部研修律師法過程，有人提案禁止涉案司法官轉任律師，但最後因涉及工作權等爭議，草案未送到行政院。法界人士指出，目前只能期待七月六日生效的法官法，排除這些司法官轉任律師。


法官法第九十七條規定，法官檢察官於自願退休或離職生效前六個月，得向考選部申請免試取得律師資格，但需取得服務機關出具的「服務紀錄良好證明」；但對於過去早已取得律師資格的老司法官，這項規定也用不上。


最近有網友貼文指出，幾個出事的法官要出來當律師，網友還暗指一位法官上班嫖妓被抓，「畢竟是法官，出來當律師，地院法官還是他學弟」。


台北律師公會日前已接獲最高法院前法官蕭仰歸申請入會，公會已經核准。


有網友稱，高院前法官楊炳禎也準備向律師公會申請入會，當執業律師；但台北及桃園律師公會表示，目前還未收到楊的申請；捲入法官貪瀆案的高院前法官陳榮和、李春地，早有律師證。


涉及收賄的高院前法官羅紀雄，已入監服刑，但他早就向多處地方律師公會申請執業，獲核准通過。


曾任台北律師公會理事長的立委尤美女表示，律師法規定曾任法官、檢察官者，可以檢覈成為律師；律師法對於不得充任律師的規定很鬆，對有案在身的司法官申請入會執業律師，幾乎沒有阻擋門檻。


有律師透露，風紀不良或有案在身的司法官最近申請律師執業，主因是去年修正的「法官法」規定，被懲戒免除職務的法官將不得充任律師，該條款七月六日生效。問題法官最近紛紛申請入律師公會，取得執業資格。
