震驚全國的昱伸公司黑心起雲劑案，彰化地院去年底一審宣判，昱伸負責人賴俊傑、賴妻簡玲媛及出售塑化劑的金童企業負責人潘淑蘭均被判重判，但負責調製起雲劑的簡鈞恒卻獲法官以不知情為由，諭知無罪，彰化地檢署昨日提出上訴，強調簡鈞恒調製起雲劑，負有釐清成分的義務，不可能不知情。

檢方上訴指出，簡某跟隨賴俊傑習藝且長時間相處，製作起雲劑的過程中，也無保密、隔閡、轉遞、隱匿之處，且賴俊傑與賴妻對塑化劑常以「SD」、「0.98」、「起雲劑用油」等用語混用，顯見該等三人對於塑化劑用於起雲劑中應有直接認知；就算簡鈞恒真的不知「SD」、「0.98」、「起雲劑用油」是什麼，但他長年參與生產、包裝，本來就有釐清添加物的義務，而且包裝上並未標示該成分，他難道都沒有追究、詢問？綜合上情，實在難認定他不知情。（記者阮怡瑜）

法庭上的攻防在於認知和欲念....
但是知跟欲也是靠證據說話....
刑法本來就從嚴認定....
法官需有幾近100%的確認才會定罪....
但是舉證責任由原告負擔....
原告要舉出讓法官接近100%信服的證據並不容易....
因此對於一般民眾而言....
刑法有罪....其實並不容易....

醫療糾紛....
法界認定舉證責任由醫師提出....
而且只要鑑定意見認為可能有疏失或是可能有因果關係....
法官就將醫師定罪....
試想....舉證談何容易....要證明100%沒有過失更是困難....

先天上....在台灣....
法律對醫療是相當的苛刻....
法律一直認為醫療就是犯罪....除非醫師可以證明無罪....

並不是刑法對該案寬容(當然可能過度寬容....我懶得深究)....
是刑法本來就不該隨便入人於罪....
只是對醫師相當苛刻罷了....

可憐....
學生們只知道醫療糾紛多....
卻不知道身處如此的不公不義和危險當中....
