林美秀（四十歲）專長家庭醫學，目前擔任聯欣診所院長，她長相甜美、口條清晰，常接受媒體訪問，昨卻透過公關低調表示：「不方便表達意見。」她的律師林詮勝也說，林還沒決定是否上訴。

判決指出，二○○五年，林美秀在以「抗老化」療程聞名的安法診所擔任主治醫師時，以為十七名病患改善免疫疾病名義，向衛生署申請專案核准進口德國製PanThymo等藥物，事後卻將十七名病患未用完的藥物，注射在另七名未經申請的病患身上。


原應撤銷醫師照
北市衛生局稽查發現後移送北市醫師懲戒委員會議處，醫懲會認定林美秀違反《醫師法》非醫療必要之過度用藥規定，並嚴重違背醫學倫理，決議廢止她的醫師執照。林提起覆審，衛生署醫懲會改認定，林違反《醫師法》業務上不正當行為，撤銷原廢照處分，改處停業六月，林仍不服，再打行政訴訟。


辯院方疏失受害
林美秀辯稱，是安法行政人員疏失，誤認另七名病患已申請用藥獲准，害她在不知情下為他們注射，還喊冤說SARS期間造成院內感染死亡的醫師，也只被罰停業三月，她的病患沒受傷害，卻被罰停業六月並不公平。


坦承學他人偷跑
但法院認定，林美秀曾向衛生局坦承依循其他診所作法，先借用其他病患獲准進口藥物，注射在尚未獲准病患身上，等獲准後再回補，因此認定她明知違反規定仍用藥，違背《醫師法》及醫學倫理，昨判她抗罰敗訴。
