地院判長庚及醫師賠十萬元

〔記者劉志原、童涵旎、陳文正／綜合報導〕一名陳姓女子找林口長庚醫院顱顏中心主任陳國鼎削骨整形，她說，醫師當初談笑風生說手術很簡單，只要花三十分鐘，就可以變成張柏芝的臉型和李玟的下巴，但手術後，她下巴變長、嘴無法張開，求償五百六十三萬元。台北地院審理認為，陳女神經受損屬實，醫院「未盡告知義務」說明風險，判長庚與醫師連帶賠十萬元。


求償勝訴仍倒賠 女子要上訴

陳女九十四年間花二十餘萬元整形，求償雖勝訴，但法院判她得付訴訟費用共五萬三千九百九十四元，陳女另還得付數萬元律師費，加上後續的逾十萬元手術費用，實際上還得倒賠，陳女說會上訴。


長庚醫院指出，此事已進入司法程序，醫院及醫師都會靜待法院公正裁判。


陳女昨天氣憤表示，她覺得自己兩頰太寬，原本只想打肉毒桿菌，但醫師建議她動削骨手術；她說，肉毒桿菌得半年打一次，「如果可以獲得永久效果，當然選擇一勞永逸的方式」。


她和醫師討論後，決定讓下巴及臉頰往下、往前各削○．三公分，但醫師卻削掉○．五公分，且兩頰角度還不一樣，「根本就是畸形」；此外，手術影響神經，有很長一段時間，她喝湯喝飲料都會流出來。她傷心且自卑，每天以淚洗面，足足有半年的時間，連買便當都不敢出門，一度罹患憂鬱症，還曾自殺。


手術失敗後，她要求醫師與院方提出解決辦法，但長庚置之不理，陳國鼎醫師還冷言說她是心理有問題，要她去看心理醫師，讓她很不滿。法院的判決則讓她二度傷害，她說，在「能計算的損失」部分，手術費就將近二十萬元，還有超過一年無法工作的損失，「賠十萬要幹嘛」。


醫療行為不適用懲罰性賠償

陳國鼎強調，陳女已簽手術同意書，知道相關風險，且陳女憂鬱症與手術無關。台北地院審理認為，陳女手術後神經受損屬實，醫院無法證明沒有過失，自得認定有過失。


法官認為，陳女對手術結果不滿，是個人對美感評價的差異，且手術前醫師與病人溝通不足，造成雙方期待有落差，但手術並未失敗，且醫療行為不適用消保法的懲罰性賠償規定，判陳女獲賠十萬元。
