基隆市一名少女就讀國中的時候，常遭班上林姓等三名男生辱罵「粉紅豬」、「死胖子」、「胸大無腦」，還多次毆打她成傷，並疑導致她罹患精神疾病，而且有自殺行為。基隆地院法官認為校園霸凌是女學生患病因素之一，判決三名男生與家長要連帶賠償女學生四十六萬元。

本案發生在民國九十四年及九十五年間，當時四名當事人都是國中生，現在已經念高一。

女學生母親指控林姓等三名學生以身體特徵為嘲弄，使女兒飽受痛苦。還常用書本、教鞭揮打女兒，甚至拳腳相向，造成女兒受傷；她女兒於九十五年曾就醫，診斷出罹患憂鬱症等精神疾病，經兩年藥物及心理治療仍未康復。

她表示，女兒原本成績優秀，但受到霸凌後變得很憂鬱，功課一落千丈，經常處於恐懼，把學校看成不安全的環境。她提出醫療、看護、財產損失、撫慰金等損害賠償，共求償兩百卅八萬元。

林姓等三名學生承認，確實有叫女學生「粉紅豬、螢光豬」等語，但是沒有嘲弄的意思，也沒有打傷她，只是嬉戲，有時是自衛還擊。

法官認為，女學生身上瘀傷多達八處，面積都很大，即使林姓等三名學生是因打鬧而還手，也有過失。

判決指出，醫院診斷女學生為「創傷後壓力症候群」，治療後仍有懼學、拒學等行為，認為其精神病理符合受林姓等學生之霸凌行為所致。

不過，法官也認為精神疾病往往有多重病因，女學生人際關係處理的問題、對課業表現過高之期許、對母親的意見不一致等，都可能是患病成因或是加重因素，林姓等三名學生的行為，只占女學生患病成因的百分之卅。

法官計算，女學生所受財產上損失為一百四十四萬元，換算成三成，即為四十三萬元，精神撫慰金則以三萬元為宜，據此判決三名學生及他們的家長，要連帶賠償四十六萬元。
