前總經理質疑健保署過度使用行政權 李伯璋：非外界所傳

健保署最近查處藥師跨區為民眾宅配藥品、醫師盜刷健保卡等案件，引發爭議。前健保局（現為健保署）總經理張鴻仁5天來，在臉書上連發7篇文章，直指健保署處理過程不妥。張鴻仁說，發文與健保署查處有關，主軸很簡單，就是「健保署過度使用行政權，事關人權問題」。健保署長李伯璋回應，健保署員工盡忠職守，為醫界和民眾的錢把關，事情並非外界所傳。

張鴻仁說，就牙科醫師盜刷健保卡案件，以他的經驗，看不懂這案子，醫師為何要羈押禁見，最後造成醫師自殺。外界想了解真實情形，健保署卻以醫師患憂鬱症才會自殺輕輕帶過，但這事關人命，可以如此簡單回應嗎？

「這是重大人權問題。」張鴻仁表示，這種違規案件罰錢處理即可，為何要動用司法的龐大力量，把人關起來，不認罪就羈押禁見。

張鴻仁說，健保署用非常強勢的行政力量，對違規者的態度是「說你錯，你就錯」，且直接開罰，一罰就罰很重，如藥師「跨區」宅配藥品案件，縱使藥師有錯，但並非殺人放火，健保署卻把藥師的藥費扣掉，使藥師周轉不靈逼到破產。不能說對方有錯，健保署就成為正義魔人的化身，這已超過開罰的比例原則。

「這是十分沉痛的呼籲，以前不知道這些事，現在聽到這幾個故事，用人權出發點看，真的感覺好可怕，現在的健保署到底發生什麼事情。」張鴻仁說，醫師、藥師的經歷都是很嚴重的事，是大事，不是小事，大家應該要重視，希望訴諸民意，台灣是自由法治的國家不應該發生這些事情。

張鴻仁今天在臉書又寫下，健保剛開辦後沒多久，許多學者認為「單一公營」的保險人黃金時期大約只有10年，之後會失去「創新與改革」的動力。但是沒有人預測到，今天會在健保署看到「霸道」，這個專制政府的特質。

面對外界質疑，健保署長李伯璋說，台南歸仁某牙醫診所2012年12月接受健保特約以來，被病患發現8年間在拔牙部位再治療，牙醫師公會全聯會進行專業輔導，也發現該診所曾多次被查獲在假日及晚上盗刷健保卡，進而申報費用。2019年起，健保署陸續接獲多名病人檢舉，因查看健康存摺發現就醫紀錄有異，所以移請檢調偵辦。

檢調偵辦發現，該牙醫診所持有39張健保卡，浮報金額超過3600萬元，為避免帳冊等證據被銷毀或串供，檢察官聲請羈押診所負責醫師獲准。後經律師陪同下，負責醫師坦承違規並願意歸還所得，今年為止已還款2000多萬，都回到牙醫總額。李伯璋強調，「健保署並未要求放大倍數償還，羈押是檢察官辦案流程，不是健保署可指揮。」

另藥師宅配案，李伯璋說，該藥局一年申報健保費用高達兩億，經查發現有跨縣市調劑送藥的合法性疑義，經爭審委員會認定法條確實有不清楚之處，因此僅扣調劑費一千多萬，藥費一億7千多萬都已發還，並啟動特約修正作業。

李伯璋說，因該藥局合作的安養機構開立處方也有疑似違規，分區業務組須繼續查，該藥局才會有健保署緊咬不放的印象，但處理過程均符合法定程序，絕無「政府迫害、整到破產」。

李伯璋強調，台灣人都很愛健保，健保署員工更是盡忠職守，為醫界和民眾的錢把關。這兩天許多人看到那些發文，特別來詢問，經過說明，都能夠理解事情並非外界所傳。
