開放加工(協助)自殺的議題-有立法提案

曾銘宗委員版「病人自主權利法增訂第14條之1」條文草案，允許醫師協助特定病患執行安樂死案。
一、曾銘宗委員等16人，鑑於為顧全人性尊嚴與基本人權，肯定臨終病患自主之選擇權，制定安樂死之相關規定，協助無法醫治的末期病人與家屬解除痛苦及折磨，前體育主播傅達仁先生亦致力推動安樂死合法化，以落實人性尊嚴及安樂善終之選擇權，爰提出「病人自主權利法增訂第14條之1」條文草案，允許醫師協助特定病患執行安樂死（如附件）。
二、安樂死議題涉及道德、哲學、倫理、宗教及法律等多方層面，十分複雜，在全球辯論了數十年，仍然沒有明確的共識和結果。目前已立法容許協助自殺的國家僅有德國、瑞士、美國部分州(華盛頓特區、加州、奧勒岡州、科羅拉多州、佛蒙特州、華盛頓州、蒙大拿州、夏威夷州)、加拿大、澳洲（維多利亞州）等。
三、以自主意識或自決權去決定執行安樂死，非僅牽涉個人、家庭，一旦在公共政策層面落實安樂死合法化，則有可能被濫用、削弱醫學的研究動力、究責問題、對安樂死執行者的心理影響等爭議，因此必須十分嚴謹慎重。安樂死的目的是希望早日脫離病痛的折磨，惟目前無法改善的病症，不代表未來醫學進步以後無法改善。醫師協助自殺的作法具是否符合道德、生命醫學倫理和法律、民眾對醫師的救人期望等疑慮。
四、現行《安寧緩和條例》及《病人自主權利法》，已拉展出國人「尊嚴善終」的空間，讓病人能在特定情況下，表達拒絕急救或維持生命治療的意願，並在緩和醫療照顧下，與家人道謝、道愛、道歉、道別，再離世（被動安樂死）。
五 鑑於安樂死有極高的道德、倫理爭議，尤其「加工」自殺疑慮，若無社會多數共識與法律配套，可能讓醫療團隊被冠上「謀殺」、「劊子手」等惡名。
