醫療糾紛調解是建構在鑑定結果沒有疏失由醫方全部賠償了事的基礎上

對於法務部與衛福部聯合推動醫療糾紛鑑定速決調解案，身為臺灣醫事法律學會理事長，我以個人身分，表示以下嚴正聲明：
「台中地院模式所提高的醫療糾紛調解成功率，是建構在鑑定結果醫方沒有疏失的個案，醫方全部賠償了事的基礎上。這是一個法庭聯合病患壓迫醫界的惡劣模式，不應該按照目前台中地院模式推動。」
個人從台中地院剛開始推動這個模式，就開始參與。也前後參加多次台中地院模式成效檢討的討論會。其調解結果發現沒有送鑑定的案件，調解成功率跟以前差不多；送鑑定的案件，八成以上醫方沒有疏失，但醫方全部賠償了事；一成多的案件鑑定結果醫方有疏失，卻只有一件調解成功，其他案件病方全部提高求償金額進入法庭訴訟。因此台中地院的整體「調解成功率」大為提升，係建構在確認醫方沒有疏失的情況下，醫方花錢消災所得到的成功率。這個制度一旦推行，將會讓醫療糾紛案件不減反增，不論有無過失，醫方均須賠錢！只要告醫師，一定有錢領！
如果法界與衛福部想要有具體施政，以減少醫療糾紛訴訟，個人的建議如下：
1.衛福部可以考慮讓有意願進入司法訴訟的醫療糾紛案件，基於使用者付費精神，負擔合理費用後請求鑑定。如果使用者不用負擔合理費用，將會更加助長醫療糾紛濫訴情況。
2.檢察官或法官不應該球員兼裁判，讓沒有疏失，不願意賠償，有意願進入法庭爭取其清白的醫師們，因為檢察官或法官跳下來進行調解，在沒有疏失的情況下，還是不得不賠錢了事。
3.檢察官對於醫療糾紛案件，可以先審視其是否取得鑑定結果，如果病方未取得有疏失之鑑定結果，或者病方取得之鑑定結果為無疏失，檢察官應逕行依法做成不起訴處分。
