桃園一名7歲女童，遭倒車逃逸的毒犯輾死，桃園警方今(29日)凌晨在新北市三峽區，發現駕車的22歲丁姓女子；警方在逮捕丁姓女子時，陪同在旁的蔡姓男子還一度想開車衝撞警方，凌晨1點丁姓女嫌犯被帶回警局偵訊，對於只顧逃逸卻輾死女童，完全不發一語。

桃園昨(28日)發生一起員警攔檢可疑車輛，但駕駛倒車竄逃，結果撞死路旁攤販的女童後逃逸，外界質疑警方為何不開槍攔阻？前警大教授葉毓蘭現在指出背後可能原因。

葉毓蘭指出警察消極執法，應跟法官以「逾越比例原則」的有罪判決，「警告」員警不可以積極執法有關。

葉毓蘭昨在臉書轉貼該則新聞報導，並以「最不願意看到的新聞還是發生了!」為題發文，指出警察因積極執法被判有罪，基層員警受到教訓，而且桃園地方法院一而再、再而三，以「逾越比例原則」的有罪判決「警告」員警不可以積極執法。最終，遺憾發生，7歲小妹來不及長大，慘遭竄逃車輛撞死，受害者家屬是否應該向法官要個說法，討回公道？

去年桃園市政府警察局警員葉驥因為開槍射擊拒捕的通緝犯被判有罪確定，日前桃園市保安大隊又有員警因為追緝拒絕攔檢的毒犯，毒販自撞摔死後座乘客，警察因積極執法被判有罪後，基層員警就學到教訓，而且是桃園地方法院一而再、再而三，以「逾越比例原則」的有罪判決「警告」員警不可以積極執法…

沒想到後果來的如此之快，今天桃園發生一起員警發現可疑車輛，只能持警棍敲打車門教人下車，嫌犯不下車還倒車，警察沒開槍，也沒有駕駛警車追逐，只跑步追車，但犯嫌倒車撞死路旁攤販的女童肇事逃逸。

我們心疼7歲小妹來不及長大，但是不禁要問，如果不是桃園地院一再以有罪判決讓警察畫地自限、怯於積極執法，小妹不知道能否逃過一刼？女童的家人是否應該去法院向法官討公道?
