近日醫界為了是否接受立法院已於去年5月8日全案審查完竣，僅第３３條規定關於補償基金來源之規定保留的「醫療糾紛處理及醫療事故補償法」而爭論不休，本人期期以為不可，提出論點。

有人以為是醫界無法接受由醫界負擔30%補償基金的問題，其實乃是公理正義的問題。試問如果「真」有「問題教師」，現社會要求要淘汰，但能接受師生糾紛採基金補償就放過「真相」嗎？醫改會過去一再強調「只是想知道真相，不是要錢。」但演變成至今的事實是「補償比真相重要」，且可彌平一切？

醫糾補償法不只是在敗壞社會風氣，鼓勵病家告醫師；些許縱容醫療謹慎度，讓醫糾的醫病制衡失效。筆者以為制定千萬不可不慎。

【台北大學法律系鄭逸哲教授】說：「醫糾補償法」如果通過，一年10億可以擺平嗎？是無比天真幼稚呢？還是蓄意在騙人騙鬼呢？在金錢的誘因下，你會不會先申請「補償」再說？你不申請，自然也會有「熱心人士」督促你提出申請。
健保失敗之處在未考慮人性，醫糾補償法亦是。你知道民間保險公司，每年花在詐保是上百億嗎？現沒醫糾法尚是如此，一旦通過將更變本加厲唷！

祈求醫病雙方，互相給多一點尊嚴，少一點譴責；多一點包容，少一點仇恨；多一點同理心，少一點苛求。各行各業都有少數頻頻出錯的負面異類，如問題教師、恐龍法官、美河市和大巨蛋等，該淘汰就淘汰；反之，「仙人打鼓有時錯，腳步踏差誰人無」？偶有醫效不滿意，有必要惡之欲其死嗎？

但不需要要求醫界搞一個醫糾補償法去包庇異類，縱容保險蟑螂的第二春，卻由大多數盡忠職守的醫師買單吧！

逮到機會就要惡搞西醫師.你看看中華民國中醫師公會全國聯合會最近
每年都有交保護費呢,難怪醫改會對中醫師都很客氣 (鬼點子)
