逾百萬人受惠 勞退自願提繳擴大適用 外配、攤販全入列

行政院會昨天通過「勞工退休金條例」修正草案，全面擴大勞工適用自願提繳退休金對象，除納入陸配、外配，包括計程車司機、SOHO族、攤販等自營工作者全面適用，勞工每月自行提撥六％退休金也可於次年綜所稅扣抵。

根據勞委會資料，目前依勞保條例提撥退休金總人數約五百四十萬，包括陸配、外配與攤販、SOHO族、計程車司機等約一百三十五萬自營工作者並無退休金相關規範，這次勞退條例修法全面納入適用，以保障勞工權益。

有關自營工作者自願提撥退休金方式，勞委會官員解釋，勞工可自行向勞保局辦理開始提繳手續，並按月扣繳。

這次修法也新增多項條款，包括勞工請領退休金後繼續工作，提繳年資重新計算，雇主應依規定提繳勞工退休金。勞委會官員解釋，例如勞工年滿六十歲退休，不論先前退休年資可請一次退或月退，倘若繼續工作到七十六歲，也可再次請領月退。

此外，修正草案增訂身心障礙者得經失能認定後，提前領取一次退休金；由於身心障礙面臨醫療需求，勞委會放寬勞工未滿六十歲前，符合一次請領退休金，但若該類勞工沒有經濟需求，也可以等到六十歲後請領月退。

草案也規定，保險人應依保險法規定專設帳簿，記載投資資產的價值，而勞工死後無指定請領人者，年金保險退休金的本金和累積收益，應歸入年金保險專設帳簿的資產。

行政院長吳敦義表示，這次修法擴大勞退適用範圍，讓勞工老年經濟生活有更多保障，勞委會應積極協調立院朝野黨團完成立法程序，讓勞工權益受到更多保障。
