嘉義某診所僱請獸醫科畢業的吳姓男子擔任醫師助理，對患者做「飛梭雷射」美容手術，造成林姓男子鼻頭被削平，以10萬元和解。但林男認為損害不只這個金額，訴請賠償52萬元，台南高分院合議庭認為和解金額合理，駁回請求，全案確定。
吳男與醫院負責人詹姓醫師都因違法，被判刑6個月及宣告緩刑確定，其中詹姓醫師捐20萬元做公益，才換得緩刑。
林姓男子指出，98年3月間至嘉義某診所求診，遭診所以半強迫方式推銷「飛梭雷射」美容手術，共計6次療程，金額3萬5000元。第6次療程時，吳姓男子以雷射探頭對他的鼻頭部位集中猛打，造成鼻部潰瘍性傷口、鼻頭被削平。
台南高分院合議庭認為，林姓男子的鼻部傷害不是很嚴重，診所之前給付的和解金10萬元合理，駁回其他金額請求，且不得上訴。
