全球前三大藥廠英國葛蘭素史克（GSK）藥廠亞太區總裁韋伯（Christophe Weber）昨（4）日表示，台灣的健保藥價調查為全世界獨有的作法，有違公平交易原則。
GSK是全球第一大藥廠，亞太市場去年營業額9.65億英鎊（約新台幣471.6億元），為全球第一大藥廠。
韋伯表示，GSK可以理解全球各國為降低醫藥公共支出，政府都會與藥廠進行議價，但唯有台灣的衛生署實施健保藥價調查，這種制度有違反公平交易原則。
韋伯指出，衛生署每次進行藥價調後，接著定出藥廠和醫院必須遵守的固定比例藥價差額，限制藥廠和醫院之間的市場交易行為。
韋伯強調，台灣藥價調查經常讓藥廠無所適從，衛生署對藥價調查經常是說做就做，毫無時間規範，每次調查完成後，藥廠一定會被要求藥品價格大幅調降。
衛生署2000年起，依「全民健康保險藥價基準」每兩年展開一次藥價調查，上一波藥價調查時間在2008年，今年衛生署再度要求進行藥價調查。
像台灣這樣已實施健保的國家，韋伯呼籲應降低心血管用藥等慢性病的給付額度，讓民眾自付更多的金額，或者擴大學名藥使用比例；對於癌症等較具高風險的疾病，提高健保給付比重。

公平交易法第五條規定的獨佔事業為
本法所稱獨占，謂事業在特定市場處於無競爭狀態，或具有壓倒性地位，

定之情形者，視為獨占。
第一項所稱特定市場，係指事業就一定之商品或服務，從事競爭之區域或
範圍。


第十條規定
獨占之事業，不得有左列行為︰
一、以不公平之方法，直接或間接阻礙他事業參與競爭。
二、對商品價格或服務報酬，為不當之決定、維持或變更。
三、無正當理由，使交易相對人給予特別優惠。
