法官：北高欠費案 應依判決執行

〔記者楊國文／台北報導〕北、高市府積欠勞健保費案，爭議多時，近來傳出行政院擬端出解套方案，行政法院高層官員昨日表示，「法律只有一個」，法院已依法做出判決，相關官員不依法行事，有很大問題。

該高層官員也認為，若行政院要以行政手段解決，對非設籍的北、高市民，由中央和直轄市政府各分擔一半健保欠費，仍需立法機關背書、修法，且立法機關有「立法限制」，是否可以「溯及既往」、符合法律保留原則，都需審慎行事。

審理過北市健保費補助款案的某行政法院法官表示，對新任衛生署署長楊志良追討健保欠費的做法，「舉雙手贊成」，他認為，法院判決確定的案件，怎能置之不理呢？

這位法官說，健保欠費案的債權人是國家，即使債務人是北、高市府，也要依判決執行才對，他質疑說，「法律不能因人而異」，因當時的北市長馬英九砲打中央，不願繳交，就一直拖延下去，何以其他縣市政府都能依法乖乖的繳？

該法官指出，勞健保欠費爭議，就法而言，依全民健康保險法第二十七條、勞工保險條例等相關規定，都說明應以「投保單位」為基礎，計算應負擔的勞健保費補助款，但因當時北市府堅持以設籍台北市的「居民」為限，且九十五年間有五十二件勞健保費案在台北高等行政法院審理中，因而引起關注。

為解決「設籍說或投保單位說」的法律疑義，因此於九十五年五月二十三日，最高行政法院舉行庭長、法官聯席會議，並達成共識，仍認定應以投保單位為依據，才符合相關法律規定。
