一名男子與女性友人晚上在鶯歌鎮的私人墓園前停車「吃便當」時，以轎車右前輪壓到的路旁水溝蓋突然下陷，造成車輛嚴重毀損、兩人多處受傷而聲請國家賠償30萬元。台北縣工務局原擬同意賠償7萬多元，不過提報縣府國賠審議委員會審查後認為不符常理，決定不理賠。

工務局指出，由於該路段屬工務局管理維護，受傷女子並未聲請國賠，而是男性車主一併求償，國賠委員認為該處水溝蓋是混凝土，除非車體有激烈運動，在自然情形下不致於破損滑落，加上受損情形與水溝蓋下陷有相當差距，因此決定不理賠，目前正擬書面通知請人，聲請人若不服可提出訴訟。

北縣國賠委員會主委陳坤榮解釋，姑且不論已婚的孤男寡女晚上到墓園「吃便當」是否屬實，若靜止的右車輪「突然」壓壞水溝蓋，理應僅底盤及右前輪部位受損，與轎車前擋風鏡大半凹陷、碎裂，顯係外力撞擊的狀況並不相符，更無法證明該水溝蓋管理維護不當，或轎車嚴重損壞、車上男女受傷與水溝蓋的「正常使用」並無相當因果關係，因此委員會不同意理賠。

陳坤榮也指出，這件聲請國賠案的案情頗離譜，若真予賠償，搞不好承辦人還有圖利他人之嫌。

申請國賠的已婚男子聲稱，去年9月30日晚間近8時，他載一名女性友人將車子停在鶯歌鎮大湖路一處私人墓園前吃便當，右前輪壓住的水溝蓋突然破損下陷，導致他的右胸挫傷及女性友人頭部受傷，車子前擋風玻破損、引擎及底盤、輪子都受損。

他主張縣府除賠償女性友人頭部受傷就醫的560元之外，他的車子兩次維修費用7萬6355元、到國術館及看中醫等醫療費4萬9千多元、替代交通費6千多元、精神撫慰金15萬元等，合計30萬元。
