醫療補償 生育事故擬優先

行政院衛生署醫事處長許銘能表示，醫療糾紛處理及醫療事故補償法若完成立法，生育事故擬朝無過失補償方向，且列優先實施。

立法院社會福利及衛生環境委員會日前審議醫糾法草案，全案已完成逐條審查，但因多條爭議條文無共識，法案未完成初審。

審查達共識條文明定，醫療事故補償，得由中央主管機關視財源狀況及急迫程度，分階段5年內訂定適用醫療機構、科別、類型或項目；為促進女性生產健康及安全生產環境，政府採分階段辦理時，生產風險有關類型及項目，應優先實施。

許銘能受訪時表示，現行生育事故救濟試辦計畫對流產、早產、因懷孕或生育導致孕產婦心理或精神損害不良結果、院方過失等，列為不補助對象；未來醫糾法規範的生育補償，將參考現行作法，朝無過失補償方向執行。

他表示，除生育事故補償優先實施，臨床上常發生不可預期傷害的手術、麻醉等，因風險太高，也列為優先補償科別。

至於爭議條文，許銘能說，行政院版醫療事故補償基金，來源包含醫療機構的補償金、政府預算、捐贈、基金收入及其他收入；但目前對醫界、政府負擔比例沒有共識。

他說，有立委主張應採「無過失補償」，但這樣對補償基金壓力甚大。目前修法方向是希望只補償責任難以釐清者，在條文中明列不補償項目，無列入者均補償，若醫院有明確過失，則仍應由醫院負責，政府可先補償，再向醫院代位求償。

社福衛環委員會召集委員蘇清泉說，醫糾法立法有助改善醫病關係，預計4月中旬再擇期討論爭議條文，希望儘速完成初審。
