【案例】

64歲男子魏政雄2008/7/16遭機車撞傷而骨折，送亞東醫院急診後，護士依44歲主治醫師張君健指示注射「頭孢子菌抗生素」，張男卻發生過敏性休克變植物人，隔年3月過世，家屬憤而提告。張男辯稱麻醉前評估報告雖提及魏男對不明藥物過敏，但魏男說不出藥物，僅告知對海鮮過敏，才打過敏性低的抗生素。但檢察官採信魏男胞弟證詞，認定事前已告知對該藥過敏，且魏男健保卡有註明，依業務過失致死罪起訴張男。報導╱孫友廉


【判決】

板橋地院發現，魏男胞弟針對何時告知醫師對該藥過敏，4次證詞都不同，也沒指出是何種藥物；至於健保卡註記，魏男胞弟表示兒子就醫時，發現家族對該藥過敏，哥哥才在健保卡註明，但法院查出，魏男胞弟之子無法確定對何種藥物過敏，故認魏男如何註記有疑問，判張男無罪。


【麻醉注意事項】

★術前與麻醉醫師討論最適合麻醉法。
★若有藥物過敏，務必告知醫護人員。
★全身麻醉前至少禁食8小時，以免麻醉時嘔吐物造成吸入性肺炎。
★應填寫麻醉前評估單、簽麻醉同意書。
★麻醉後可能有頭痛、噁心及背痛等症狀，若不適應主動告知醫師。
