五人以下的公司行號，雖不必強制替員工投保勞保，但根據台北地院一件職業災害補償訴訟案的判決，員工一旦發生職災，在未排除適用勞基法的情況下，雇主仍得負起未投保勞保的職災補償。

一位在不足五位員工的連鎖冷飲店工作的王姓男子，上班途中發生車禍死亡，他的老闆陳男，因未替王投保勞保，法官判必須給付四十五個月平均工資的喪葬費、死亡補償費，共計一百廿六萬元。

本件判決，所有雇主都得注意，如果未替勞工投保勞保，一旦產生勞保給付問題，雇主可得負起賠償責任。

王姓男子去年四月起，以每月二萬八千元的薪資受雇一家連鎖冷飲店，擔任廚房及外送工作。去年十月十八日上午十一點五十四分，他在上班途中發生車禍，送醫後不治死亡。

台北地院勞工法庭審理後，法官認為依勞基法第三條第三項前段規定，勞基法是適用一切勞雇關係，並沒有就應適用勞基法的事業單位雇用人數另設限制。

勞基法雖規定，受雇五人以上的公司、行號員工，應以雇主或所屬機構為投保單位，全部參加勞保，只涉及雇主是否應強制為勞工投保勞保的義務，不是在排除勞基法的適用，陳不能以員工五人以下，沒有強制投保勞保義務作抗辯，判他必須給付賣喪葬費和死亡補償共一百廿六萬元。
