沒錢請律師 二審幾乎都被駁回

〔記者項程鎮／台北報導〕單親媽媽自力打二審官司獲得勝訴，相當不容易；監察院正要查司法院和高等法院，為何民眾上訴二審若請不起律師，案子幾乎都被駁回！


台大法律學院副院長王兆鵬也說「這樣的結果令人震驚」，似乎司法院主管的刑訴法，在弱勢民眾前築起一道上訴二審無法跨越的鴻溝。


監院明天將開諮詢會議，請法界、司改團體、律師界及學者出席，表達對二審上訴案件駁回情形的看法；據王兆鵬教授的統計，高院駁回案件中，有94%為被告上訴案件，其中98.5%的被告未請律師，顯示弱勢民眾訴訟權遭剝奪。


法律扶助基金會秘書長郭吉仁對此表示「這個問題非常嚴重」，法扶基金會有責任加強推廣，幫弱勢民眾請律師打官司。司法院官員則說，這是法律規定上訴要件，不是法院刻意駁回上訴，且許多案件是竊盜和毒品案件，可能因事證明確，被告上訴時無法提出具體理由。


主持監院諮詢會議的監委李復甸表示，刑事訴訟法第361條在96年7月4日修正後，規定上訴二審書狀須敘明具體理由，否則案件無法進入二審實體審判，立法用意原要減少濫訴案件上訴二審，讓司法資源用在真正需要仔細審酌的案件上，不料修法後卻讓案件太容易被駁回，導致請不起律師的民眾，無法受到高院審級利益的保護。


王兆鵬還發現，蒐集96年7月4日到97年7月3日的高院及全國各高分院案件，發現案件遭駁回873位被告中，只有13位由律師或公設辯護人辯護，其餘860位案件遭駁回被告，統統沒有請律師。
