醫療糾紛補償 將限灰色地帶

行政院會今天通過醫療糾紛處理及醫療事故補償法草案，由政府成立補償基金，對醫療事故屬於難以分明責任歸屬者為補償給付。

為減少訟源，草案建立調解先行原則。草案明訂，提起民事訴訟前，應先經調解；刑事訴訟中的案件，包含公訴、自訴、告訴乃論等罪，檢察官或法官取得病人或家屬同意，也可移送調解。

草案規定，補償給付限於死亡、重大傷害給付2類，避免醫事人員認為無須再負責賠償而影響其自律心、責任感及醫療品質。

衛生署副署長林奏延說，草案未訂補償金額與上限，將待通過立法後，在相關辦法中修訂。至於補償基金規模，1年約新台幣10億元至12億元。

補償基金的來源方面，草案規定，包含醫療機構繳納醫療風險分擔金、政府預算、菸品健康福利捐、捐贈收入等。政府預算撥充及菸品健康福利捐，以不超過醫療事故補償基金總額的30%為上限。

草案規定，醫療事故的補償，不採取無過失補償制度，僅針對醫療事故屬於難以分明責任歸屬者為補償給付；屬病人原有疾病病程進展產生意料中的死傷、非以治療疾病目的的美容醫學醫療行為等，都不補償。

草案規定，採補償給付申請，與民事訴訟、刑事自訴或告訴原則不得併行。

為讓病人迅速瞭解真相，醫療糾紛發生後，草案規定醫療機構應在院內、院外成立關懷小組，委託專業團體，提供民眾諮詢，並規定醫療機構應在2個工作天內提供病歷。

草案明訂，中央主管機關辦理醫療事故補償案件，原則上於2個月內完成，必要時，得延長2個月，並以1次為限。這項草案將送立法院審議。
