醫師納入勞基法的方向，勞委會樂觀其成。-王如玄

（中央社記者魏紜鈴台北2日電）近來傳出有血汗醫院致過勞死消息。勞委會主委王如玄今天表示，醫護人員超時工作，不僅影響勞工個人身心健康，也影響醫療品質，「醫師納入勞基法的方向，勞委會樂觀其成。」

行政院勞工委員會主任委員王如玄今天上午到立法院社會福利及衛生環境委員會作職業災害保護專案報告，提出上述表示。

國內出現醫護人員工時過長，遭血汗醫院以奧步壓榨等問題。勞委會已檢討勞基法第84之1條責任制，確定「醫療保健服務業」分2階段回歸正常工時。

王如玄說，醫護人員超時工作，不僅影響勞工個人身心健康，也影響醫療品質，「已取得醫師執照的受僱醫師，納入勞基法的方向，勞委會樂觀其成。」

但「實習醫學生」納入勞基法，王如玄仍有疑慮表示，「實習醫學生」是教育學程一部分，非受僱勞工，不應將實習醫學生視為廉價勞工，應從受教權益出發，才能提供更好的保障服務。

民進黨籍立委陳歐珀質詢時，請工傷協會專員賀光卍於會中報告指出，雇主讓勞工過勞形同殺人，應課以刑責，目前日本及韓國超時工作皆入刑責，要求勞委會參照，才能遏止不肖雇主的違法行徑。

王如玄答詢表示，目前針對雇主強制要求勞工加班，其中包含「故意」與「直接因果關係」，現行勞基法已有相關6個月以下有期徒刑、拘役或併科新台幣30萬元以下罰金規定。

本身是心臟外科醫師的國民黨籍立委蘇清泉也認為，雇主讓勞工加班致死就課以刑責，「應平衡考慮、謹慎評估，否則台灣會變成很恐怖的國家。」

此外，中華民國全國工業總會理事長許勝雄今天對「勞委會盼法制化激勵企業加薪」表示，政府不宜越俎代庖管企業調薪。

王如玄對此回應，企業若自願為勞工加薪，勞委會當然舉雙手贊成，勞委會盼在社會企業責任基礎下，研擬激勵措施「鼓勵」企業調薪，照理來說企業應會樂觀其成，若有不同意見是「誤會」，「有些企業號稱關心社會，並捐款給許多團體，呼籲企業應先善待自己的員工。」1010502

當初為了多剝醫師一點皮

本人是公立醫院的公職醫師，長期觀看本論壇的文章，從中學到很多。一直未註冊會員，只因嫌麻煩。但是有些意見不吐不快，今天終於加入本論壇，第一次發言。

針對本篇勞委會的說法，我相當不以為然。
衛生署主管醫療業務，指的是醫療機構的管理、醫事人員的資格審定、教育訓練等等。但是，醫院經營者(資方)跟受雇醫師(勞方)之間的工作契約關係，明顯是勞資問題，不該歸衛生署管，而應該是勞委會的權責範圍。
勞委會長期忽視不管，推給衛生署，是廢弛職務。

牽扯到財團和既得利益者，勞委會就變軟了，衛生署就變硬了。醫師納入勞基法的議題果然複雜到寧願瀆職或違法也不惜擋下 。
