正常情況下
如果是 刑事附帶民事訴訟,民事應與刑事訴訟同時判決
但這案例明顯不是如此
我看這論壇的案例, 多是各告各的, 因為刑事附帶民事訴訟刑事若原告敗訴, 民事就不樂觀

第500條 附帶民事訴訟之判決，應以刑事訴訟判決所認定之事實為據。但本於捨棄而為判決者，不在此限。

第501條 附帶民事訴訟，應與刑事訴訟同時判決。

第502條 法院認為原告之訴不合法或無理由者，應以判決駁回之。
認為原告之訴有理由者，應依其關於請求之聲明，為被告敗訴之判決。

第503條 刑事訴訟諭知無罪、免訴或不受理之判決者，應以判決駁回原告之訴。但經原告聲請時，應將附帶民事訴訟移送管轄法院之民事庭。
前項判決，非對於刑事訴訟之判決有上訴時，不得上訴。
第一項但書移送案件，應繳納訴訟費用。

反觀斷掌理賠官司時, 怎麼就會進一步質疑求證
檢方是否能指出棉絮是那個環節有出錯才留下的, 是否排除造假的可能

醫病關係的惡化, 每每都說成醫師沒有同理心,
這個天價都能開出來, 還談什麼同理心
防衛心比較重要吧
