老闆不能再罵人？ 罵下屬公司連坐

上司罵下屬，公司被連帶處罰，這樣的案例在台灣比較罕見，法官解釋，是因為上司在教訓下屬的時候，是以上級的身份，因此認定在行使主管職權，如果言行失當，公司等於是沒有盡到注意責任；不過，這並不代表以後所有的案例通通都適用，因為每個法官見解不同，也會按照不同的個案，來作出應有的判決。


上級罵下屬，原本被認為是天經地義，但內容涉及人身攻擊，在法律上就站不住腳；不過法官強調這只是個案，每個案子的狀況大不相同，判決結果，因法官而異。

士林地院行政庭長蔡明宏：「被告對於原告為辱罵的行為的時候，是以主管的身份與執行職務有關，所以就是認定被告兆豐公司，要與另一被告付連帶賠償責任，因為每個法官審判，都有自己的法律見解，跟當時的個案的特殊的情節，所以未必就其他個案，能夠一予延用。」

事實上，公司連帶賠償的特殊案例就發生過好幾起，一名護士在自家醫院接受腹腔鏡手術，結果造成不孕，法院判醫院應該連帶賠償259萬，而客運駕駛在乘客沒站穩的時候就貿然開車，乘客受了傷，一審也判客運要賠392萬，還有一名65歲的重聽老先生，向兒子借計程車載客出了意外，靠行公司也跟著賠84萬。

換句話說，明明公司能事先預防，卻沒有注意而造成侵害他人的行為就得負責，與員工連帶賠償，這樣的案例一出現，讓員工大聲叫好，但不少企業老闆卻開始頭痛。
