康軒「醫糾單元」教導蒐證 醫界超不爽

〔記者吳柏軒、林惠琴／台北報導〕康軒文教公司出版的國小六年級健康與體育課本有「醫療糾紛」單元，內容卻引起醫界人士不滿，痛批將醫療行為視為消費行為大錯特錯，恐使醫病關係惡化；康軒發言人許牧民說，該篇是教導學生認識醫療糾紛，知道醫事人員和病人、家屬的義務等，未來將檢討，課本改版時將斟酌用字。


將醫療視為消費行為

該「醫療糾紛」內容寫到，「身為醫療消費者，一旦發生醫療糾紛，必須蒐集病歷、處方箋、手術同意書、護理紀錄、照片等證據」。新上任的中華民國醫師公會全聯會理事長邱泰源指出，醫療與消費不同，這種內容「教一個人就害一個人」，醫師與患者間應保持信任，防來防去不利醫病關係。

醫師公會要求導正就醫觀念

邱泰源表示，醫師公會將努力改善現況，短期先研擬說帖，兩週內提供教育部、立法院遊說盼求導正錯誤，中、長期則設法教育民眾，從小養成正確就醫觀念，促進醫病良性發展。

負責研擬說帖的北市衛生局醫管處前處長、台大醫院急診醫學部主治醫師劉越萍說，約廿年前馬偕醫院發生肩難產案被家屬告上法院，當時法官援引「消費者保護法」的服務提供人「無過失責任」規定，判醫院賠償，但大法官解釋醫療行為不是消費行為，不適用消保法。

醫改會研究員辜智芬強調，可經合法方式向醫院申請病歷或相關資料，而非自行拍照、錄音或錄影，並徵詢另一位醫師的專業意見，假使對院內溝通結果仍存疑義，可進一步向地方衛生局申請初步鑑定與專業調處。

國教院請康軒明年二月推新版

國家教育研究院教科書發展中心主任楊國揚說，該版教科書已發行六年，執照只到今年六月，本學期結束後不得再發行，已請康軒和醫師公會檢討內容，明年二月將推出新版教科書，若雙方有共識則尊重，若無共識，則將召開諮詢會議，由教科書審議委員對內容做最後確認。
