醫療官司費時 衛署擬推及時補償

國內醫療糾紛案件逐年增加，但一審刑事判決平均得等上三年多，讓當事人忿忿不平。衛生署「醫糾處理及補償法」草案增加「提供及時補償」規定，未來病患如符合補償標準，最慢100天內能拿到補償金，死亡個案的補償金約200萬元。

衛生署長邱文達上午出席立法院衛環委員會，針對「醫療糾紛處理及醫療事故補償之現況、問題與對策暨改善作法」進行專案報告。他強調，醫療事故訴訟花費極高，但曠日廢時，對於打官司的雙方都是一種折磨。

衛生署統計，76年至100年間有案可查的醫療糾紛案例，共有7940件，如以病患傷害程度來分析，死亡個案最多，有4471件（占56%），其次為重傷害1805件（占22%）以及傷害1450件（占18%）。

進一步分析醫療糾紛科別，以外科比率最高，共2715件，占34%，其次為內科2189件，占28%，第三是婦產科1172件，占15%。邱文達感嘆地說，這是造成內外婦兒等五大科醫師人力缺乏的主因。

76年至今國內有數千位醫師被告，但打了官司，病患這一方也沒能獲得多少實質上的求償。據統計，病人這一方平均每3.12 年才能獲得一審刑事判決。

更令人病人及家屬無奈的是，經過冗長的法律訴訟，平均不到兩成病患獲得民事一、二審勝訴。衛生署10年來醫事鑑定結果，只有一成七的醫事人員被認定醫療上有疏失，平均賠償金額為200萬元，但病人這一方在扣除律師費、交通費等，差不多只剩120萬元。

為了解決醫療糾紛，衛生署提出「醫糾處理及補償法」草案，除了強化調解機制之外，提供及時補償則是另一個重點。醫事處科長石村平表示，此法上路之後，醫病雙方調解若符合補償標準，最快在100天內就能拿到200萬元左右的賠償金。

不過，醫糾賠償金則有排除條款，當事人如果請領勞保故事傷害給付或是車禍事故保險，就必須先扣除已獲得的金額。例如，車禍事故保險金最高給付180萬元，醫糾補償基金就只需再給付20萬元。

另外，「醫糾處理及補償法」中還明訂代位追償，如果醫事人員有顯然可歸責的情節行為，將由補償基金代表或是國家向醫師求償，以符合公平正義原則。
