（中央社記者賴又嘉台北14日電）台北市立聯合醫院疑因醫師延誤開刀導致病患死亡，遭家屬提告求償。高院更審認為，病患死亡與手術延遲有因果關係，判決醫院與醫師應賠償家屬新台幣643萬餘元。全案可上訴。

台灣高等法院今天公布的判決書指出，楊姓男子於民國90年1月26日因身體不適，至台北市立聯合醫院辦理住院後，陷入昏迷，經神經內科醫師診斷發現楊姓男子腦內血腫、水腫。住院醫師於28日以斷層掃描追蹤，認為應立即開刀摘除血腫，因而通知陳姓外科醫師準備進行手術。

判決書指出，因當時正逢春節期間，陳姓外科醫師在家屬簽立手術同意書後，向家屬表示，開刀前未做腦血管攝影手術風險極大，但需到29日春節假期結束後才能進行腦部攝影，家屬因而聽從陳姓醫師建議，未立即開刀。楊姓男子於29日凌晨宣告不治，家屬認為醫師延誤診療時機，因而提告求償。

法院一、二審時均認為，醫師已向家屬解說手術原因及風險，並經過家屬同意，因此認為醫師並無疏失，判決不需賠償。

但高院更一審時，審酌法務部法醫研究所及醫審會的鑑定書意見，認為若醫師即時開刀摘除病患腦血腫，楊姓男子應不至於死亡；且陳姓醫師當時僅告知家屬手術前需施作血管攝影，卻未告知若不立即施行手術的危險性，因而認為楊姓男子死亡與陳姓醫師未立即開刀有因果關係。

高院更一審因而改判，陳姓醫師與聯合醫院必須連帶賠償死者母親、妻子及4名子女扶養費與撫慰金，共計643萬餘元。
