健保部分負擔為何該調整？違法行政不該修改嗎

這次醫師公會全國聯合會理事會有鑑於台灣健保的部分負擔收取長期違法行政，造成健保署官員的壓力，與分級醫療無法落實，更嚴重的是民眾長期都不知道自己其實是違法的共犯；同時也是造成台灣醫療資源錯置、與健保費率必須不斷調升的重大原因。因此經過詳實的調查與討論後才會提出來應該要修正「不合時宜」的《健保法》第43條。文末是一個簡單的比對表（請見文末附表）

表中是比較複雜的門診部分，急診部分就很簡單，只是將現行的急診部分負擔比率由20%調降到15%。雖然比率調降了，但是部分負擔金額卻略有調高，不過這個部分因為還有調整的空間，可以考慮把部分負擔比率降低到10%，同時一樣可以採用定額方式收取，如此就會和現行的收費標準差不多，並不會影響到民眾的就醫。

由表格中的資料我們可以發現，健保這20多年來長期一直處在違法的狀況。雖然《健保法》中明定「第一項應自行負擔之費用，主管機關於必要時，得依診所及各級醫院前一年平均門診費用及第一項所定比率，以定額方式收取，並每年公告其金額。」但是現在完全不顧是否必要，而且也沒有每年檢討與公告其金額，主管機關長期怠忽職守，雖然情有可原；但是畢竟台灣是一個法治國家，政府機關不該長期帶頭違法。

因此，邱泰源立法委員因為同時是中華民國醫師公會全國聯合會理事長，對這個部份特別清楚，也希望能夠紓解官員困擾以及民眾的就醫壓力，於是提出修正案。該修正案不但將各項比率調降落實到真實的狀況，同時為了能夠落實分級醫療與將醫療資源作最有效益與合理的運用，將未經轉診者排除於得採用定額的規定。

其實在其他先進國家中，對於未經轉診者是不能夠逕至醫院的門診就醫的，醫院門診也不接受未經轉診的病人直接就診。台灣考量民情風俗，一直不敢限制民眾的就醫權，因此長期以往，很多民眾不管身體有任何的大小不舒服，就是直接往醫學中心就醫；不但造成醫學中心過度擁擠與血汗，最嚴重的問題在於讓醫學中心無法作好本身應該要做好的研究與教學，以及對於真正需要醫學中心照護的急重症與罕見疾病。不但延緩了台灣尖端醫學與尖端科學的發展，也造成台灣的醫療呈現不合理的倒金字塔的分布狀況，醫學中心耗用最多的資源與服務了最多數的病患。

這次《《健保法》》第43條的修定案中可以看出，對於90%以上的民眾的部分負擔的制度和金額都沒有調高，甚至可能降低，只有針對未經轉診直接至醫院等級就醫的病患才有影響。這一個小小的轉變，相信會是台灣推動分級醫療的重要一步；也是讓我們健保署不用一直擔心沒有依法行政而必須負擔行政責任了。

所以這次的修法，不但可以同時解決長期健保署未能依法行政的困境，也同時讓全體國民雨露均霑，同受其惠；更重要的是這樣的修改後，才能夠真正推動分級醫療，讓台灣的健保可以永續經營。
