公費醫師一切的錯誤開始，居然是來自於"她的少女時代/他的少男時代"

上星期有我很尊敬崇拜的陽明學長老師, 突然打電話來, 想問一下我這個已經下鄉八年、早已不是公費生身分的"偽公費生", 關於公費醫師重新招考一些事情。

經過一星期的思考, 現在泡好咖啡。對著電腦，院內兩車三人，日中無聲。沉默太久，過去的包袱也太重，我想該是我表達一些意見的時候:

前幾年在偏鄉醫院(不是我現在的醫院)，我見過耳鼻喉科公費醫師同事，顫聲打電話來求救，說他在急診室遇到心跳180跳的病人，問我該怎麼處理, 也有眼科學弟，在急診室遇到休克病人，手忙腳亂，壓力大到爆棚、也聽過某些醫院長官強制急診室簽病人住院，不管該院或值班醫師是否有能力處理；有腎臟科專長的醫師，被分派到沒有洗腎室的偏鄉醫院、有心導管專長的公費醫師，被分到沒有心導管室的偏鄉醫院，根本就是人力資院的浪費。更不提下鄉的公費醫師，被凹值各種奇怪的班、以各種不合理理由扣薪水、被醫院限制不得進修或考碩博士班 (因為須留在醫院賣肝幫醫院賺錢)等等；簡單的說，這些公費醫師不但薪水差、勞動條件差、容易被凹、未來發展受限制、地位低下....

可能會有人說 「不爽不要幹啊! 誰叫這些人不爭取好的勞動條件和薪水」。問題是, 在公費期間, 去反映是沒有用的, 因為公費醫師根本跑不了; 等到公費期滿, 自然跑得像飛的一樣，這時即使下鄉單位開出好的條件，因為彼此互動太差，合約當然談不攏(何況這些單位，多半開不出好的條件, 他們也希望有新的公費醫師來，可以繼續凹), 所以公費醫師無法留任, 舊的公費醫師制度會失敗, 其來有因。而對於公費醫師來說, 這一切的錯誤開始，居然是來自於"她的少女時代/他的少男時代"

民法跟刑法上有行為能力的人，還要滿二十歲或十八歲以上，但有"醫療行為能力"則要取得醫師執照以後。特殊醫療技術，則要取得次專科醫師資格方能施行。

公費醫師制度，簽約對象是高中畢業生，這已經是不公平的起點，高中生再怎麼會上網蒐集資料，跟實務上及實際上的醫療現況，還是有很大出入，醫界長期以來大多數公費醫師都默默承受，並不會上網公告天下。何況簽約後，衛福部還擁有片面修改契約的權利。高中生和衛福部的資訊/權力/權益不對等，這已經是錯誤的第一步。新的公費醫師實施辦法，也沒有提供救濟管道，例如中途若想跟衛福部解約，衛符部得以"保管"醫師執照，擺明了吃定公費醫師。而且新的辦法較舊的辦法，要延長期限至下鄉六年，若勞動條件、薪資、願景等不改善，新的辦法一樣會面臨失敗，公費醫師一樣期滿走人。

因此，我覺得，公費醫師制度，簽約對象應該是已經取得醫師執照的人(不應該是沒有醫療行為能力的高中畢業生)，由國家或是衛福部視當時的醫療需求，分別擬好勞動條件、薪資契約，個別招醫師簽約，方能根本解決偏遠地區醫療人員不足的問題。

話說回來
簽訂任何契約，應該有審閱期
而當你填「公費醫師」的志願時，表示你已經「接受」這個你從來沒看過內容的合約
因為
如果你錄取、到校註冊後卻不簽約，等於放棄這個科系的入學資格
同時也喪失這一年其他科系的入學資格
你必須要重考

所以說，學生在沒有審閱契約的時候，就必須決定要不要簽約
這應該是有違反一些法令的

所以說
衛服部必須事先將契約公告給所有考生知道
最好是在招生簡章內公告 或者 上網公告
讓考生及家長在資訊對等情形下
決定自己的未來
