醫糾補償增設代位求償機制將迫使犯錯者說謊！

醫糾處理法草案第三十三條明訂給付補償後，非告訴乃論的刑事案件且無補償後提起民事訴訟或刑事案件之自訴與告訴，經法院判決認定應由醫事人員負責者，應向醫療機構或醫事人員請求返還。此為國家之代位求償，筆者認為萬萬不可。

醫療疏失如果是醫療人員個人過失則基金先補償的部分最後由國家向醫療人員個人代位求償，這個不符合健保公醫的精神，照理說健保為我國之社會福利制度，政府就應當為執行社會福利的人員投保醫療責任險。如果鼓勵不責難補償的話，唯有真正的不責難，才會有真正的RCA（根本原因分析）報告，所以醫糾處理法設計代位求償制度會使得犯錯的醫護人員說謊，那真正犯錯的原因就永遠石沈大海。

雖然醫糾處理法搭配醫療法第82-3條修法將過失改成重大過失，但實質上重大過失認定標準很主觀，一但法官從寬認定，醫療人員會成為代位求償法的待宰羔羊。再者，設計代位求償制度的話就沒有理由要求醫療機構與醫療人員負擔任何一毛錢，醫療人員自己去買民間保險業者的醫療責任險就好了，醫責險理賠之後也不會向投保的醫療人員求償，為何政府的基金向醫療機構與醫療人員收錢，到最後基金還要向自己求償？很顯然，這個基金只會賠不是醫療人員所犯的錯，這種強制承擔非自己過錯的收費已經違憲。對於醫療人員所犯的錯卻倒過來向自己求償，那請問為何醫療人員要繳？代位求償的時候不是把醫療人員自身該賠的一次賠了嗎？那麼之前繳的有扣除嗎？這不是重復處罰嗎？

國家應全額負擔醫糾處理法補償基金！

新加坡公立醫院最近幾年對我國醫事人員挖角頻頻, 然而新加坡公立醫院會負擔醫師幾近100%的醫責險使醫師執業無後顧之憂，而且實施醫療疏失匿名調查制度，不將犯錯的醫療人員姓名公佈，鼓勵犯錯的醫療人員誠實說出問題所在，讓全國的醫療人員從中學習。加拿大的公醫, 政府會補助醫師購買醫責險, 補助到83%。世界各國行公醫制度之國家無一把醫療責任負擔轉嫁給醫療人員, 而主要由政府吸收負擔, 如此才是醫療的公共化與非商品化。 台灣的全民健保制度自許為社會福利制度的一環, 不應該逃避醫療責任的財務負擔。 台灣社會對醫療人員之不友善應該先檢討，莫再怪外國為何頻頻挖角台灣的醫療人員。

政府搞中科四期，花了六百億，最後只有兩家廠商進駐。政府很有錢，只是都浪費掉了，真正該用在醫療與教育時，就說沒有錢。我國一年醫療糾紛賠償規模大約只有二十多億, 政府透過健保低額的給付來壓榨醫療從業人員, 不應該再把屬於健保的賠償責任轉嫁到醫療服務提供者身上。

個人覺得補償財源應該來自同樣疾病的病人
其次才考慮普羅大眾稍微幫一點.. 但這就等於變相加稅... 所以要考量國力不能一味左派
而絕不是來自醫療體系或健保總額

不知道現在草案裡面有沒有提到說
如果拿了錢又告，後來法官判定確實該事故可以歸責醫方或病方者，補償就該繳回！
到時候拿到補償80萬... 結果判醫方賠20萬... 就虧了60萬
這樣才有抑制濫訟的效果吧？
