揪「恐龍」難舉證 法官法被批雞肋

法官法於去年一月六日施行至今一年又七個月，民眾向官方檢舉不適任法官的案件已近百件，但僅有一名法官被司法院職務法庭判決休職一年，遠不符社會期待；要透過法官法淘汰恐龍法官、檢察官，必須加把勁。

社會大眾原先期待「法官法」施行後，可以讓貪贓枉法、濫用司法公權力等不適任法官、檢察官得到應有的懲戒，甚至將他們逐出司法界；然而，司法官評鑑制度施行運作一年多來，由於缺乏相關配套，成效大打折扣。

民間司改會痛批法官法根本就是「雞肋條款」，空有美麗的名詞，沒有實際效果。


中華人權協會理事長蘇友辰律師指出，最大的問題在於檢舉證據取得困難，許多民眾無力聘請律師，在訴訟中無法取得卷宗證據與法庭錄音光碟，導致檢舉法官、檢察官時欠缺證明，難以成案；尤其聲請複製法庭、偵查庭錄音光碟的問題最多，因為法庭錄音僅保存到裁判確定後三個月，民眾想要檢舉卻經常超過保存期限。

民間司改會辦公室主任高榮志表示，法院和檢察署還會以各種理由駁回民眾複製法庭錄音的聲請，包括未具體指陳法院某次開庭筆錄有何錯誤或遺漏、或是法庭錄音涉及在場其他人個資等等，都使民眾難以取得錄音光碟。

蘇友辰說，現行刑事訴訟法規定，辯護人只有在「審判中」才能檢閱卷證，在「偵查中」並無閱卷權；許多案件在偵查階段已結案歸檔，束諸高閣，根本無法取得檢舉事證。

當事人為了取得「偵查中」的光碟事證，還要花錢委任律師聲請交付審判，繞個大彎，再聲請閱卷獲得該項可以原音重現的證物；這項法律漏洞，若未補救，一切都是空談。

司改團體和部分律師都認為，要檢舉不適任法官、檢察官，就應配套開放「請求個案評鑑」的民眾可以聲請閱卷或規畫其他適當管道，取得檢舉事證做為依據，否則光從卷宗中的白紙黑字筆錄，很難找到不當言詞記錄；因為，沒有任何一位書記官會將司法官的侮辱性、歧視性、語帶尖酸刻薄言語載入筆錄之中。

人權協會指出，另一個問題是，司法院和法務部都未重視評鑑委員會的職權，法官評鑑委員會就評議案件做出具體的懲處建議，但事後司法院、法務部或職務法庭卻經常對其建議大打折扣。
