全案彰化地方法院今天審結，依詐欺、偽造文書等罪判處蔣榮祥有期徒刑４年，其餘還有該院護理人員１３人判處６月至１年１０月不等徒刑。

一審判決出爐後，蔣榮祥不願表示意見；彰化縣衛生局長葉彥伯表示，受到判決書之後，將送交彰化縣醫師懲戒委員會，決定是否對蔣榮祥處以停業等行政處分。

（中央社記者吳哲豪彰化7日電）彰化婦友醫院涉嫌幫病患施打過期排卵針，另將產檢或人工受孕病歷修改成要求作試管嬰兒，負責人蔣榮祥遭判有期徒刑4年。
針對遭判有期徒刑4年，蔣榮祥本人不願回應；彰縣衛生局則說，等到收到判決書後，將送彰化縣醫師懲戒委員會處理。
根據彰化地方法院今天公布的判決書，婦友醫院為人工受孕患者施打排卵針，而排卵針製造日期為民國92年9月，有效期限則到95年8月，醫院考量成本，違法施打原先應銷毀的針劑，直到100年遭人檢舉才停止，約有上百人受害。
除施打過期排卵針外，婦友醫院在96年取得設立人工生殖機構許可，效期3年，不過蔣榮祥為讓醫院再次通過許可，指示醫護人員將原先進行產檢、自然生產的病歷，更改成要求施作試管嬰兒的病歷，再向當時的衛生署提出季報、年報等，讓衛生署信以為真，核准醫院的申請。
法官認為，蔣榮祥不顧針劑過期，施打在病患身上，不慮及過期藥劑可能對人體產生危害，無視病患身體健康，依偽造文書等罪判處有期徒刑4年；至於同院醫護、行政人員則遭判有期徒刑2年10個月至6個月，均得易科罰金，全案可上訴。1020807
