(一) 刑法第346條第1項恐嚇取財罪：「意圖為自己或第三人之不法所有，以恐嚇使人將本人或第三人之物交付者，處六月以上五年以下有期徒刑，得併科一千元以下罰金。」同條第2項為恐嚇得利罪：「以前項方法得財產上不法之利益，或使第三人得之者，亦同。」本罪所要處罰的行為是行為人以恐嚇手段，而向被害人索取財物或財產利益的勒索行為。
1. 勒索行為：是指以恐嚇行為，使他人心生畏懼，而索取財物或財產上的利益。故勒索行為包括恐嚇行為和索取財物的行為。
(1) 恐嚇行為：是指以強暴、脅迫或其他不法手段，使被害人心生畏懼而受行為人的強制，被害者雖受強制，但尚未達不能抗拒的程度，也就是說被害人的意思自由尚未完全喪失，始為恐嚇。
(2) 索取財物：行為人須於為恐嚇行為時，明示或暗示被害人交付財物。
2. 處分財產：被害人由於心生畏懼，並進而處分屬於自己或第三人的財產。
3. 財產損失：恐嚇行為必須造成被害人本人或第三人的財產損失。且被害人的財產損失必須與行為人獲得財產利益，形成直接對等的關係。
4. 行為人主觀上須具有「勒索故意」，以及為自己或第三人不法所有的「獲利意圖」。
