3分鐘決定生死 馬總統：快設醫療仲裁
近來漸多醫療糾紛案件使醫師官司纏身，總統馬英九昨聽取醫界及學者建言後裁示，法務部、衛生署應與醫療團體研究設立醫療糾紛仲裁機制，讓民眾能在第一時間得到撫慰與權益協助。

馬總統表示，醫院對某些重症常是依法轉診，造成時機延誤，產生防禦性醫療現象，「這都是值得特別警惕之處」。最近看到各縣市出現好幾起醫療糾紛，「大家不能再忽視下去」，尤其醫生「三分鐘決生死」的壓力遠大於其他職業。

總統府昨天邀集醫師公會全聯會、醫院協會等團體及法務部、衛生署共同討論「醫糾去刑化」問題。醫師全聯會理事長李明濱表示，近年來內外婦兒急診五大科人力嚴重失衡，背後因素是醫師動輒被告的「寒蟬效應」，若根本問題未解決，年輕醫師「寧救醜不救命」。

李明濱指出，醫界希望醫糾刑責只局限在醫師有故意及重大過失，這項主張修改醫療法即可達成。

台灣醫療改革基金會執行長劉淑瓊表示，政府如果只推動醫糾去刑化，卻未改善現行醫糾調處的困境，只會增加民眾的不安。她說，民眾提醫療訴訟是不得已，因為對各衛生局的醫糾調處沒有信心，有一半縣市每年調處案件不到廿件，而且調處成功率很低。因此，醫改會要求，政府應強化醫糾調處及仲裁機制，並仿飛安事故不責難制度，讓醫療疏失不要一犯再犯。

衛生署副署長林奏延指出，衛署正研擬醫療糾紛處理及醫療事故救濟法草案，朝未來醫糾刑責合理化後的配套，重點在於「強制調處」，以避免纏訟多年，醫病雙輸，另外就是成立醫療事故救濟基金，從制度面來保障民眾權益。

馬總統說，相關單位要讓民眾第一時間清楚了解醫療糾紛處理的各種路徑圖，才能有效減少醫療糾紛的訴訟。

馬總統也要求權責部會，針對昨天會議的承諾事項，追蹤管制並掌握改善情況，必要時一個月內再開會檢討，讓昨天會談的成果盡快上路。
