小三偷精想做試管嬰兒 遭醫師拒絕

一名40多歲婦女異想天開，竟然拎著保險套，到婦產科要求做試管嬰兒，醫生覺得詭異，查看婦女身分證發現配偶欄是空白，她才坦承自己是小三，想幫情夫生個小孩。

這名小三特別從北部南下彰化，要求醫生做試管嬰兒，她一開始告訴醫生，因為老公工作忙碌沒有空，所以才會拿保險套來檢查，並且要求冷凍。

醫生一看婦女年紀已經不小，又是拿著保險套前來，心中覺得有異，要求查看婦人身分證，一看發現她是單身身分，婦人才坦承，自己是小三身分，情夫事業有成，但元配不孕多年，她很想為情夫生個小孩，來繼承大筆財產。

醫生向她解釋，若是單身想做試管嬰兒，是違反人工生殖法的，而且保險套裡都含有殺精藥，恐怕很難如願，婦人最後只能失望離去。

美國芝加哥一名女醫生跟男友醫生口交時，“私吞”男友精液，然后吐出，為自己做人工受孕，結果成功懷孕產子。她的男友知道后，一狀告上法庭，控告她盜竊自己的精液和詐騙贍養費，令他精神受創，要求賠償。
　　法庭日前作出重要裁決，指男子在口交過程中送出的精液，已屬于女方擁有，是一項送出的禮物，是不能收回的，因此女方用來人工懷孕產子，不構成盜竊和詐騙罪名。

　　這件奇案，男女主角都是醫生，事件發生在6年前，男醫生菲利普斯跟女醫生艾恩斯發生戀情，艾恩斯替男友菲利普斯口交，卻暗中私藏他的精液，保留下來，然后拿去人工受孕產子。

　　但兩人關系只維持4個月，兩年后，女方突然提出訴訟，指菲利普斯是她的孩子生父，脫氧核糖核酸（DNA）證實他確是孩子生父，法官下令他每月要給艾恩斯800美元（逾1320新元）贍養費。

　　菲利普斯突然有一名親生骨肉，認為是遭艾恩斯布局陷害，因為他和她從未發生過直接的性關系，只口交過三次，相信她是在口交時“盜竊了他的精液。

　　他說乍聽有一個孩子，精神大受困擾，長期失眠和食慾不振，于是提出反訴訟，但官司在前年被駁回。

　　法庭周三終于作出一次重大裁定，指即使艾恩斯用心不良，也絕不構成盜竊精子罪，因為“當原告射出精液，這是禮物──一份絕對無法改變產權轉移的禮物”。但法官認為艾恩斯用口交取得精液懷孕，確有可能對菲利普斯造成精神創傷，所以裁定將精神受創的民事官司發回地方法院審判。
