〔記者林良哲、蘇金鳳／台中報導〕前彰化縣北斗鎮長洪參民去年11月間開車撞上江姓大學生，學生家長認為，洪某在車禍後對江生進行心肺復甦術（CPR）不當，造成其肋骨刺穿心包膜而引發氣血胸致死，對洪提告並訴請賠償968萬元；台中高分院審理後認為，應該不是洪某進行CPR不當而造成死亡，但洪某違規轉彎是造成車禍主因，判處有期徒刑9月，並賠償428萬元。

台中高分院審理時，根據檢方驗屍報告認為，若為CPR所致傷或死亡，胸骨應有骨折情形，但死者並未有胸骨骨折或斷裂現象，因此不可能是進行CPR所致傷亡，但洪某違規轉彎是造成車禍主因，因而判處有期徒刑9月。

中國醫藥大學附設醫院急診部主任陳維恭表示，由於CPR要壓得深，有可能造成肋骨受傷，但絕不會造成死亡，國際文獻也沒有因為CPR而致死的案例。

澄清醫院中港院區急診室醫師蔡哲宏也表示，臨床上並未發生CPR造成刺穿心包膜而致死的案例，也不可能。
