被老東家告跳槽詐欺 女醫師獲判無罪

知名的皮膚科女醫師林軼鵲，被老東家卓玉麗醫師，控告以假流產為由提前離職並跳槽，還藉此少給64萬元的違約金，有詐欺之嫌。由於雙方曾簽定離職協議書，並言明賠償金額，士林地院認定林軼鵲沒有詐欺罪證，昨天判她無罪。

2009年5月5日，林軼鵲與卓玉麗簽約，同意從同年的6月1日到2011年5月31日，在卓開設的皮膚科診所任職，並約定若服務未滿2年而離職，林女應賠償96萬元。

林軼鵲在卓玉麗診所任職期間，曾多次向同事表示她懷孕，有流產跡象，想提前離職，回母親經營的婦產科診所休養。當時卓玉麗以人手不足為由，多次挽留。最後，雙方於2009年7月20日簽定讓林軼鵲離職的協議書，並言明只要賠償32萬元。

由於林軼鵲離職後不久，跳槽其他診所，甚至還自行開業。卓玉麗認為林謊稱流產，讓她陷於錯誤，才簽定協議書讓林離職，並少收64萬元違約金。為此，卓玉麗向士林地方法院提起自訴，指控林軼鵲涉嫌詐欺。林軼鵲否認詐欺，強調自己確有流產跡象，才申請離職。

由於證人都證明林軼鵲確實曾說有流產跡象，要求提前離職，加上卓玉麗無法證明林軼鵲說謊，法院認定林女沒有詐欺，判她無罪，此案可上訴。卓玉麗人在國外，未能採訪；林軼鵲則不表意見。
