〔自由時報記者黃立翔／台北報導〕販售含塑化劑濃縮果汁的金果王、金吉王公司，士林地院合議庭昨天依違反「共同詐欺取財未遂罪」、食品衛生管理法，判老闆陳阿和一年四個月，兩公司併科罰金僅八十萬元。

另本案中，會計林美惠被判十個月徒刑，調配師張益誌（陳阿和長子）、員工陳協增兩人則因僅受命負責調製、加工，其他不知情，判無罪，全案仍可上訴。

檢方原求刑12年 法官從輕認定

本案起訴時，陳阿和被士林地檢署首度以俗稱「千面人條款」的刑法「流通有毒食品罪」追究，具體求處十二年徒刑、併科一千萬元罰金，全案四被告、兩家公司併科罰金共六千四百萬元，但法官審酌無證據顯示金果王繼續調配塑化劑，僅追究五月十九日金果王被通知起雲劑有毒後的兩次出貨，從輕認定。

去年起訴金果王的檢察官古慧珍已升任嘉義地檢署主任檢察官，她昨天請產假無法回應；士林地檢署襄閱檢察官顏迺偉則表示，收到判決書後會再研究上訴事宜。記者昨走訪位於士林的金果王公司，但公司內無人，陳阿和手機也沒開，不知其回應。

士林地院行政庭長李育仁表示，金果王、金吉王雖進貨大量含塑化劑的起雲劑，但無證據顯示十九日後仍繼續以此調配、製造濃縮果汁，且另進貨楊?公司合格起雲劑，雖又被再次發現毒物殘留，但劑量極低，應是器具遭舊品污染，因此只追究五月十九日之後的兩次以「舊品」出貨，起訴與判決結果才會大不同。

合議庭也認為，「千面人條款」是針對將有害人體健康的物質公開陳列販賣或摻入公開陳列販售的飲食物品中，金果王屬上游供料廠商，並非將有毒物質直接摻入公開陳列的食品、飲品中，構成要件不符，不宜擴張解釋。
