〔記者楊久瑩／台北報導〕遲來的正義，算正義嗎？足足等了七年，考試院終於還給十位九十五年中醫師專技特考生一個公道，不但正式公告、補行錄取，考試院長關中並為此公開道歉。

正義遲來 特考補錄取10人

七年前，因為差○．○五分落榜的施明財，以及差○．八二分就錄取的歌手葉蔻（本名陳懿琳）昨天得知自己終於上榜，都不敢置信，頻頻問記者：「真的嗎？」多位考生都表示，不排除請求國賠。

民國九十五年，參與中醫特考的應考人葉蔻及施明財等人，落榜後質疑應試科目「中醫方劑學」及「中醫眼科學與中醫傷科學」簡答題，有兩題評分不公，提起訴願，要求重新閱卷，歷經五次訴願與兩次行政訴訟，台北高等行政法院於去年十一月做出判決，要求考選部應在兩個月內依參考答案，重新評閱試卷另為處分。

考選部長董保城昨坦言，過去法院對考試評分訴訟，多表尊重，這次法官高密度介入審查相當罕見，考選部邀集學者專家研商後，決定尊重台北高等行政法院的判決結果，不再上訴。

葉蔻答案全對 只給了5分

高等行政法院詳查葉蔻等考生的答題考卷後，發現閱卷老師的給分漫無標準，葉蔻的答案與命題老師提供的答案完全一樣，理應得到滿分十分，閱卷老師竟只給了五分；有的考生答錯一個，竟拿到九分；但是同樣答錯一個，有人則拿到六分；有人同樣完全答對，卻得到六分。重新閱卷給分也同樣一團混亂，看不出標準何在。

由於國考考卷通常只保留一年，要不是葉蔻當初向法院聲請扣押所有考卷，閱卷委員亂給分的真相還未必能夠公諸於世，葉蔻昨痛批，國家考試有太多黑箱作業。

關中道歉 盼考選部獲教訓

關中昨天特向「纏訟多年」、受盡委屈的考生施明財、葉蔻等人公開道歉，希望考選部從本案中得到教訓，避免再發生評分不當的問題，確實保障應考人權益。

董保城強調，會以此案例提醒閱卷老師謹慎給分，命題老師提供的參考答案要更明確詳實。為此，考選部已將命題老師的費用從三千五百元提高到六千五百元。

考選部昨天公告補錄取的十人中，已有兩人後來考取了中醫師，實際補錄取的其實只有八人，考選部將會重新寄發結果通知書，錄取人員須再經一年六個月訓練，期滿成績及格才發給證書。中醫師特考已經於去年取消，昨新增的八位錄取者，將是國考史上「後無來者」的最後上榜生。

葉蔻等人打算請求國賠，董保城說，請求國賠是人民權利，考選部尊重。至於後續是否擔心及格邊緣考生狂提訴願及訴訟？董保城說：「會擔心，但無法禁止。」
