告前夫偷生子 算錯排卵日敗訴

〔自由時報記者蔡彰盛／竹市報導〕重新計算排卵日，舉證小三受孕日是在他離婚後，遭控與小三通姦生子的竹科工程師，獲判無罪！
檢推算受孕日在離婚前
陳姓女子與郭姓前夫於98年3月4日離婚，因郭男拒付贍養費，陳女99年7月向台中地院提起民事訴訟，聲請郭男應履行給付贍養費義務，陳女聲請郭男戶籍謄本時，發現郭男名下竟多了1女，且是在98年11月13日賴姓小三產下（係預產期提前2週剖腹產），陳女推算賴女受孕時間，應在她離婚之前，憤而告郭男妨害家庭，新竹地檢署偵查認為孩子已生是鐵證，將郭男起訴。
郭男的律師楊隆源發現，陳女與檢方都是以臨床婦產科推算預產期方式，將預產日往回推280天（即所謂「妊娠週數」，即母體從懷孕到胎兒出生），認為精卵著床應在98年2月20日迄3月4日（這天離婚）之間，而咬定前夫在離婚前就通姦生女。
但郭男矢口否認，指3月4日離婚後，他在賴女的生日3月6日這天慶生時向她求婚，當天兩人才發生第一次關係，並在懷孕後結婚，2人堅稱孩子絕非私生子，更無通姦之事。
律師楊隆源主張，月經後有所謂「安全期」，所以妊娠週數的280天，應扣掉前14天女性沒排卵的日期，實際僅有266天，因月經來潮起算的14天內，稱為濾泡期，之後才會排卵，才能受孕。
賴女稱懷孕前的最後一次月經來潮，是98年2月20日左右，因當年2月只有28天，加上排卵所需的14天，也是在3月5日左右才會排卵，2人在3月6日發生性行為，當然有可能懷孕，如以3月5日加上真正妊娠週數的266天，也符合預產期的11月27日左右，楊隆源據此向法院聲請鑑定。
醫院鑑定受孕日在離婚後
院方請賴女產檢的醫院鑑定受孕日，結果從超音波的胎兒長度與頭骨推斷，認為在98年3月5日附近，並非在檢方所指控的98年2月20日到3月4日離婚日之間，因此判決郭男無罪，可上訴。
法官雖調出賴女的病歷，發現她96、97年共墮胎3次，且最後1次就診填寫的緊急聯絡人資料竟是郭男；但因檢方起訴僅針對郭男非婚生子部分犯行，這部分僅供法官參考。
