〔記者徐夏蓮／台中報導〕中山醫學大學附設醫院計劃7月1日起調降員工薪水，昨天有員工抱怨院方並未依勞資會議實施辦法與勞基法規定取得員工同意，不過中山附醫副院長曾志仁昨天表示，全案尚未定案，還在和員工協商，中山附醫絕不會做出違反勞基法的任何情事。

中山附醫員工投訴本報指出，院方片面公告降薪即違反勞基法第21條規定，勞工自得以雇主有同法第14條第1項第6款之情事，不經預告終止勞動契約，並依同條第4項規定準用同法第17條資遣費之請求，如雇主僅為預告減薪之通知，尚未對勞工具體減薪，其結果亦有損害勞工權益之風險，勞工亦得行使不經預告終止契約權，並請求給付資遣費（以寄存證信函方式）。

這名員工痛心表示，私底下大家已準備串聯來個集體總辭，先領一筆遣散費，院方為了能維持營運，勢必要和員工簽訂新的勞動契約，屆時員工即可掌握薪資主導權與工作保障權，揚言員工們一定會善用法律賦予勞工的同意權與工資議定權之行使，團結抵制不法以保障權益，防杜院方任意減薪，導致各種勞工權益全面縮水。

院方保證不違法

中山附醫副院長曾志仁表示，中山附醫不是降薪，而是將薪水制度回歸到和全國各醫院一樣而已。

中山附醫保證即使經過這波調薪，員工的薪水還是會比同層級醫院、同層級職位員工薪水至少高出3000元。
