92年9歲男童楊智堯因治療蛀牙，拔除14顆牙死亡案，士林地方法院審理認為，醫師為楊童拔管不當致昏迷死亡，有醫療疏失，判決三總及醫師連帶賠償楊的父母330萬餘元。

楊父控告內湖三軍總醫院牙科部主任楊晉昱、麻醉科醫師沈振庭、小兒科加護病房醫師林偉仁涉及業務過失致死。衛生署醫事審議委員會鑑定，認楊童是因罹患先天性心臟病，拔管後因腦缺氧昏迷，住院期間又併發氣管糜爛波及食道，最後因出血休克死亡，三名醫師沒有疏失，處分不起訴。

94年7月，楊父不服處分而聲請再議。法院將醫療過程再送醫事審議委員會鑑定。法官參考醫審會的鑑定結果後認定，楊童治療蛀牙麻醉後連拔14顆牙齒的過程，牙醫和麻醉醫師沒有疏失。

但是小兒科加護病房醫師決定拔管的時機，以及拔管後照護不當，致楊童昏迷死亡則有醫療疏失。法院昨天判決醫師和醫院連帶賠償楊童的父母喪葬費、精神慰撫金共330萬餘元。本案仍可上訴。
