公然侮辱罪的成立要件
刑法第309條的公然侮辱罪，第1項是普通公然侮辱罪，法定本刑可處拘役或三百元以下罰金。本罪的犯罪成立要件，共有三點如下:

1.要有侮辱的行為:

侮辱無論是用粗鄙的言語、舉動，嘲弄謾罵或其他輕蔑人的意思，使人產生難堪狀態的行為都包括在內。如果使用強暴方法進行公然侮辱，像對在社會上有名望，有地位的人士心存侮辱，公然給他巴掌；或用穢物公然傾倒他人頭面等等，用這些帶有暴力行為的公然侮辱他人，這就不是普通公然侮辱罪的範圍，要依第309條第2項的強暴公然侮辱罪處斷，法定刑罰是一年以下有期徒刑、拘役或新臺幣一萬五千元以下罰金。

2.把這些減損他人聲譽的行為定位為「侮辱」:

必須行為人知道自己的行為足以減損被害人的聲譽，還是執意使這些行為發生，具有侮辱他人的犯罪故意。至於怎樣的情況才算公然?目前實務上界定犯罪的侮辱行為，是否達到公然的程度，只有少數的特定人在場，就不能算是公然。例如:夫妻關起門吵架互罵對方，如果只有少數的特定人在場，就不算是公然。若把吵架的場地，由屋內搬到屋外的馬路上，便是人來人往的公共場所，雙方口無遮攔侮辱他方的惡言惡語，都為不特定的多數人所共見共聞，這就成立公然侮辱罪。

3.公然侮辱罪的被害客體是「人」:

處罰的法條就是明定公然侮辱人才予處罰，反面的意義若侮辱的不是人就不可能處罰。人在法律上有兩種含意，一種是有血有肉，可以稱「你、我、他」的自然人，另一種便是依法律規定成立的法人，像公司、合作社、農會、漁會以及依法具有公法人身分的政府機關、人民團體已經依人民團體法的規定，向法院辦妥法人登記成為法人，都是這個法條中所稱的人。
