教育部軍訓處花蓮聯絡處已婚上校軍官朱開志，五年前疑與一名職校女員工發生婚外情糾紛，《蘋果》報導此案時，刊登朱男的網路照片，朱男認為肖像權被侵犯，控告撰稿記者李光濱求償一百萬元，台灣高等法院昨判李須賠償朱男七萬元。朱男仍可上訴。

壹傳媒法務經理葉錫波說：「因朱男涉嫌以總教官職務權勢，對女方施壓，《蘋果》才登他照片，目的希望公務員謹慎行事，且照片取自學校公開網站，並無侵權。」
朱開志昨說：「《蘋果》願刊登自己敗訴新聞，也派記者問我回應，我覺得有被尊重，考慮放棄上訴。」朱目前已離職。
《蘋果》是在二○○八年十一月二十日，刊登「狂發簡訊 已婚上校罵女友是妓」報導，從學校網站擷取教官朱開志（五十歲）的照片，刊登後挨告。
高院認為，朱男感情糾紛與公眾利益無關，沒必要讓全台灣知道他長相，且朱男願讓照片貼在學校網站上，不表示他願把照片登在發行量高達數十萬份的《蘋果日報》上，《蘋果》未經其同意登照片，侵犯「肖像公開權」，因此判記者須賠償朱男七萬元。
