法院判要患者出院 並還103萬醫療費

台中市有一個病人、前年六月住進中國醫藥大學附設醫院、長達一年多的時間，去年八月院方要求他出院、並且繳交一百多萬元的醫療費用，但是這個病人完全拒絕，醫院只好打官司、讓法官來主持公道。而法院最近判決病人敗訴、必需歸還病床、還要繳清醫葯費。
台中一位年約四十歲的盧姓患者，前年一月因為不定時全身癱軟，中國附醫醫師查出是先天性甲狀腺機能亢進，合併其它特殊罕見症狀，患者要求住院，同時列為教學研究個案。101年8月，醫療團隊認為沒有盧姓患者沒有住院的必要性，要求他出院及支付上百萬的醫療費，被患者拒絕。

被告指控原告有疏於醫療

所以原告請求被告
給付醫療費用也有理由
患者罷床事件，提出民事告訴的中國附醫，低調不願回應，患者物品還在院內，但人已經出院。台中地院法官審理後，認為患者曾在中國附醫住院期間，又自行到署立台中醫院及中榮就診，還因為吃甜食緊急又住進台中醫院的病房，已經沒有在中國附醫住院的必要性，法官裁定被告廖姓患者敗訴，必須出院，同時返還103萬的醫藥費。

患者罷床不繳醫藥費，醫院用提告解決，在醫界並不常見，主要是因為打官司曠日廢時，同時也會給社會不良觀感；台中地院指出，醫療資源有限，應該提供給最需要的人，以司法途徑解決罷床爭議，全案還可以上訴。
