目前有一萬多名退休軍公教人員及政務官，十八趴月息超過五萬元。昨天甚至傳出有高階司法人員，退休共領到一千四百多萬元，轉存十八趴月息超過廿萬元，這次十八趴改革卻完全砍不到他，成為最大的「漏網之魚」。
高額十八趴月息退休族已引起立委的關注，包括國民黨立委廖正井等人，這兩天一直追著銓敘部要這些領高額十八趴的退休者資料，電視叩應節目也窮追不捨；逼得銓敘部不得不表態，強調領高額十八趴月息，即使當初領一次退休金，未來也會衡平考量，有可能訂十八趴優存額度上限。
銓敘部昨天舉行座談會，向全國及各機關的公務人員協會及退休人員協會說明這次年金改革內容，會中砲聲隆隆，許多人痛斥這波改革對退休人員而言，不只造成「皮肉傷」，而是「刀刀見骨」，退休金及十八趴同時被砍，將來月入少了兩萬多元。
全國公務人員協會副理事長葉仁成更直指，某些政務官併計公教人員的年資，退休時領了一大筆錢，轉存十八趴月息超過五萬元，但因採一次退，這波改革完全沒被砍，銓敘部也應清查、規範。
銓敘部解釋，目前退休軍公教人員及政務官若領月退金，只能拿一次養老給付轉存十八趴，常務官月息最多兩萬八千多元，政務官也限制月息上限三萬元；超過三萬元的，幾乎都是拿一次退休金及養老給付轉存十八趴，其中政務官不到三百人，多數是教師及法官。
台銀統計，目前十八趴月息超過三萬元，共有四萬兩千多人，其中有一萬三千八百多人月息超過五萬元，若他們當年領一次退休金，這次都不會被砍到。
據了解，月息超過五萬元的，為數不少是退休法官，因法官是終身職，退休時除可領退休金、公保一次養老給付，還可領到一筆退養金；若退休金、退養金都是一次領，加上公保養老給付，最高紀錄有人領到一千四百多萬元，全都轉存十八趴，月息多達廿一萬元；即使存一半，也有十萬多元。

所以法官退休金最高是一般軍公教人員的240%,
