從美國牛肉到醫療糾紛，看持續淡定的衛生署（作者：肥李）

最近攸關全民健康的議題，除了含瘦肉精的美牛進口問題外，還有一個有關如何處理醫療糾紛的公聽會。

7月6日法務部召開「醫療行為刑事責任之探討」公聽會，對於是否限縮醫事人員醫療行為刑事責任做公開討論；本人有幸參與。會中，贊成方與反對方互有立場，申述己見。雙方雖有對話，但交集不多。唯一一個無論是醫界、法界、民眾都有的共識，就是：衛生署怠惰失職。

醫療本身就充滿了不確定性。一個醫療事故的發生，究竟有沒有疏失，究竟有沒有過失，實需要醫療專業人士來判斷。而無論是不是疏失、是不是過失，也必須有人傾聽病患、家屬的聲音；必須有人瞭解病患、家屬的訴求；以及撫慰醫療事故中受到傷害的一方。瞭解醫療的極限、公正鑑定醫療事故始末、同時傾聽病患、家屬聲音、撫慰人心並化解歧見，正是衛生署的責任。

無奈衛生署推諉卸責，讓醫界、法界與民眾之間的歧見在公聽會上赤裸裸地上演。

衛生署對外要求修改醫療法；但對內的制度改革，包括各方呼籲的：推行醫療第三人責任險、推行不責難補償制度、加強醫療糾紛協調機制等等，一概視而不見、聽而不聞。 與醫療訴訟相關的醫療糾紛處理法草案，老早就送到立法院；衛生署推行不力，立法怠惰。 而長期被人詬病的黑箱醫事鑑定過程，也亟需做根本上的改革。

台灣的醫療環境失衡，衛生署責無旁貸。 偏遠地區找不到醫師，醫院難以生存，衛生署兩手一攤，沒有辦法。 都會地區醫院像百貨公司一樣，一棟一棟地建、一床一床地開，衛生署睜隻眼閉隻眼，毫無管理。 對於民眾的衛生教育、促進民眾健康、呼籲珍惜健保資源、建立轉診制度，衛生署又曾做過什麼？ 對於六大皆空（內、外、婦、兒、急診、麻醉）、護士荒，衛生署又提出過什麼有用的解法？

做做事吧，衛生署，不要只會喝紅茶淡定了。
