查無事證！被控隱匿禽流感 許天來案簽結

農委會動植物防疫檢驗局被指隱匿高病原禽流感疫情，前防檢局長許天來等人涉嫌廢弛職務釀成災害罪，台北地檢署調查後，以查無刑事犯罪的具體事證，上午將全案簽結。

檢方指出，整理防檢局前局長許天來在歷次專家會議的發言，以及家禽流行性防制規範草案的訂定過程意見，許天來始終都堅持相同的專業觀點，並無犯罪的故意。

檢方說，就客觀疫情防治，防檢局於疫情發生之初，不論高病原或低病原病毒的判讀，重點是有無延宕，本案所涉及的禽流感事件，移動管制及生物安全防疫機制，都由地方防疫機關適時啟動，對於禽流感病毒的防疫，即使未以全場撲殺為手段，但仍有一定的成效。

檢方指出，本案是否有廢弛職務，應就整體防疫作為觀察，而非僅侷限於禽流感高低病原性的判定，因此，縱使許天來於專家會議中，對於高病原性禽流感病毒要件的堅持，造成認定上的延遲，但若地方防疫機關防疫工作啟動配合，即無廢弛職務問題。

檢方說，我國屬OIE會員，有關禽流感事件的發生，即應適時向該組織通報疫情，但因通報網站，以點選選項及上傳報告為通報方式，並非以鍵入IVPI的精確數據方式為之，且點選後無從更正，這是OIE通報系統操作，與防檢局認定要件所造成，無偽造文書無關，因此將全案簽結。
